Welcome to the website of Graffiti HeArt. These Terms of Service explain the terms that apply when you visit our website, submit a form, make a donation, sign up for communications, inquire about a mural or public-art project, express interest in volunteering, sponsorship, artist opportunities, events, tours, or otherwise interact with Graffiti HeArt online, by phone, by email, or by text message.

Graffiti HeArt is a Cleveland-based 501(c)(3) nonprofit arts organization focused on graffiti, street art, murals, artist support, community beautification, public art, youth art education, scholarships, events, tours, and community partnerships.
1. Use of Our Website
You may use our website for lawful purposes only. You agree not to use the website in a way that:

By making a donation, you agree to provide accurate payment and contact information. Donation processing may be handled by third-party payment processors, and their own terms and privacy policies may apply.

4. Sponsorships, Events, Tours, and Program Participation
Graffiti HeArt may offer sponsorship opportunities, events, tours, volunteer opportunities, artist opportunities, public-art projects, and related programs.
Participation may be subject to additional requirements, agreements, waivers, deadlines, eligibility rules, payment terms, cancellation terms, or event-specific policies. If there is a conflict between these Terms and a signed written agreement or event-specific policy, the specific written agreement or policy will control for that activity.
Graffiti HeArt reserves the right to accept, decline, reschedule, cancel, or modify events, sponsorships, project opportunities, artist opportunities, volunteer activities, or program participation when necessary.
5. Mural, Wall, Public-Art, and Project Inquiries
If you submit a mural, wall, public-art, or project inquiry, you agree that the information you provide is accurate to the best of your knowledge.
Submitting an inquiry does not guarantee that Graffiti HeArt will accept, quote, approve, produce, manage, or complete a project. Project acceptance may depend on factors such as mission fit, artist availability, budget, timeline, wall or site conditions, property permissions, permits, safety, insurance, legal requirements, and organizational capacity.
You are responsible for ensuring that you have the authority to submit information about a property, wall, site, organization, business, or proposed project.
6. Artist, Volunteer, and Community Submissions
If you submit artist information, portfolio materials, volunteer interest, photos, descriptions, documents, or other materials, you confirm that you have the right to submit those materials.
Submission of materials does not create an employment, contractor, volunteer, partnership, artist representation, commission, or agency relationship unless a separate written agreement is signed by the appropriate parties.
Graffiti HeArt may review submitted materials for internal evaluation, follow-up, project planning, volunteer coordination, artist opportunities, or community engagement.
7. Intellectual Property
Unless otherwise stated, the website content, text, design, graphics, logos, images, layout, and other materials are owned by or licensed to Graffiti HeArt and are protected by applicable intellectual property laws.
You may view and share website content for personal, educational, charitable, or informational purposes, provided that you do not remove attribution, misrepresent the content, or use it in a misleading or unlawful way.
Artwork, murals, photographs, artist portfolios, project images, and other creative works may be owned by individual artists, photographers, partners, sponsors, or other rights holders. You may not copy, reproduce, sell, modify, distribute, or commercially use any artwork, mural images, artist work, photographs, or creative materials without permission from the appropriate rights holder.
8. User-Submitted Content
If you submit content to Graffiti HeArt, including messages, photos, project descriptions, site details, testimonials, comments, or other materials, you grant Graffiti HeArt permission to use that content as reasonably necessary to review your inquiry, respond to you, administer programs, coordinate projects, maintain records, and support nonprofit operations.
If Graffiti HeArt wishes to use submitted content publicly for marketing, storytelling, fundraising, social media, press, or promotional purposes, we will make reasonable efforts to obtain appropriate permission when required.
Please do not submit confidential, proprietary, highly sensitive, or private information unless specifically requested and appropriate safeguards are in place.

Even if you unsubscribe from marketing emails, we may still send non-marketing communications such as donation receipts, event confirmations, direct responses to inquiries, administrative updates, or legally required notices.
10. Text Message and SMS Terms
Graffiti HeArt may offer text message communications for individuals who choose to receive them. Text messages may include updates, reminders, responses, and follow-up related to donations, events, tours, volunteer opportunities, mural or project inquiries, sponsorship, artist opportunities, appointments, or general organization communications.
By providing your mobile phone number and opting in to receive text messages from Graffiti HeArt, you agree to receive text messages from Graffiti HeArt at the phone number provided.
Message frequency may vary. Message and data rates may apply.
You may opt out of text messages at any time by replying STOP. After you reply STOP, we may send one final confirmation message to confirm that you have been unsubscribed. You may reply HELP for help or contact us at tag@graffitiheart.org or 216-412-9991.
Consent to receive text messages is not required as a condition of making a donation, purchasing goods or services, attending an event, volunteering, sponsoring, submitting a project inquiry, or otherwise engaging with Graffiti HeArt.
Graffiti HeArt does not sell, rent, or share SMS opt-in information or text message consent with third parties or affiliates for their own marketing purposes.
